A 383-page amendment detailed Reid plans to steal money from 49 states to foot Nebraska's share of an expansion of the Medicaid program while other states are on the hook to pay for their own. Nelson dropped what now appears to be a phony concern over abortion coverage in the bill and took the payoff.

Reid and the White House are using PAYOFFS AND THREATS TO ANYONE THAT STAND IN THEIR WAY then if that does not work change the Senate rules to end debate with.

IT IS A SAD DAY
It is a sad day for the US constitution when one of the biggest human rights, the right to assure your own health and well being, is taken away from you.

It is a sad day for Patriots.

PELOSICARE PASSED
PelosiCare just passed in Congress. It will probably pass in Senate. And Obama, the most *Wild Card* and least understood president of all times (by his own choice by NOT disclosing ANY documents about his past), is chomping at the bit to sign it in law quickly, by the end of this year.

WHY IS IT A SAD DAY
Why is it a sad day. And, being a patriot you know it. How do you know it? Have you heard of the V.A.? Veterans Administration? I hear a lot of patriots who are quite unhappy with it. Vietnam Veterans, Iraq Veterans. V.A. as a government administration, has it's own rules and regulations. You can only go to this V.A. hospital. You can not go to any other hospital. You MUST go for an annual exam, otherwise they kick you "off their list". Maybe you were in Vietnam, fighting for "democracy" and "liberty". And what do you get now through the V.A. - a mediocre government handout. A mediocre level of care, and severely limited choice of doctors. Probably severely limited choice of medical procedures as well. Well but at least the government is "taking care of you".

BUT WAIT, MAYBE YOU LIKE THE GOVERNMENT TAKING CARE OF YOU?
Well as long as you are okay with relying on the government, you needn't complain. As long as you feel the government choice of doctors and hospitals is better than your own, you needn't complain. Either you haven't been sick much, or you like what the government is doing through other "services" such as IRS, Medicare, Homeland Security.

WHAT IF IRS AND MEDICARE HAD A BABY
In fact, I saw yesterday Rep. Issa comparing the new PelosiCare Bill as what would come out if "IRS and Medicare had a baby". What an ugly image!

THIS IS WHAT PELOSICARE WILL LOOK LIKE IN A COUPLE YEARS
How do you feel as a patriot being forced to purchase your own healthcare (expensive!) until it ruins you financially?

And then when you are financially ruined, how do you feel about asking (begging?) the government for subsidies to your forced healthcare monthly premium?

Are you a wealthy Patriot? How do you feel being taxed an extra 5% to finance this government monstrosity of PelosiCare? This will bring your taxes to 45%, maybe over 50%. I'm assuming states will increase their taxes as well. You, as a wealthy patriot, will be taxed the most. You will be taxed more than you would be taxed in all other developed countries in the world. So much for the Land of the Free. So much for looking forward to making it in the U.S. of A.

Just wait and see. Maybe you really need to get sick a few years from now and need to get in a six months waiting list for a MRI or colonoscopy like the Canadians (especially the elderly Canadians) to understand what kind of "care" your favorite congressmen have in mind for you.

MAYBE YOU DON'T NEED TO LOOK FAR TO SEE YOU'VE BEEN SCAMMED
Maybe you just don't need to wait that long. Maybe you just need to see what other details Pelosi and company have sneaked into the bill in the last minute. It's a 1900 pages long document. A document messing with you, Dear Patriot and Freedom Seeker.

HOPE?
I am losing hope in this matter. The only way out of this mess I see is to repeal this law ASAP especially next year when many Democrats are kicked out of Congress for the work they did against the American people's liberties. Or to replace the Congress altogether with a constitutional entity keeping their hands off personal liberties that are guaranteed by the U.S. Constitution.

Got this in an email today from Ron Paul's Campaign For Liberty. Text of the proposed bill thanks to http://www.politicalcoffeehouse.com.

Basically, J. Rockefeller (D-WV) is giving Obama just what Obama wants: Complete control over the internet, including the ability of shutting the commercial internet and YOUR WEBSITE down.

Internet is the last bastion of the free information flow and free commerce. Now Obama wants to take this away. Amazing.

S. 773 Senate Bill 773

Dear Fellow Patriots:

Please take your time and read this letter and Senate Bill 773 (s. 773) carefully.

Because if a bill quietly sneaking its way through Congress passes, emails with information like this could be the last non-government message to ever hit your inbox.

In fact, someday you may even find yourself unable to log  in to your email in the first place!

I know what you're thinking: Maybe  this is just another Internet hoax.

I wish it was.

But Barack  Obama and Senator Jay Rockefeller (D-WV) want to make this nightmare a  reality.  That's why Rockefeller recently introduced S. 773, "The  Cybersecurity Act of 2009."

Initial cosponsors include Senators Evan Bayh  (D-IN), Bill Nelson (D-FL) and Olympia Snowe (R-ME).

You see, Barack Obama is seeking sweeping new powers to "shut down" all private internet in the event of a "cybersecurity emergency" — a vague term that the President can define at his discretion.

And Rockefeller's bill gives Barack Obama just  what he wants.

That's why this expansive new power grab should really  be called "The Internet Takeover Bill."

As you know, the Internet has developed into an independent sphere where 1st Amendment Rights can still be (fairly) freely exercised.

It's also become an important outlet for liberty-minded speech, cutting around the Obama-worship and corporate censorship of the mainstream media.

And we've already seen the Obama  Administration's reaction to any online speech they deem "fishy."

In July, the Administration called upon Americans to report their friends' and neighbors' emails to help Barack Obama silence the "disinformation" about the Obamacare bills in Congress.

Well now Barack Obama wants to cut  out the middle man.

If the Internet Takeover Bill passes, Barack Obama  can silence his dissenters directly — by ordering a shutdown of the  U.S. Internet.

That's right, under this bill Barack Obama  can order all non-government U.S. networks to shutdown from the  Internet.

But that's not all.

Even outside of periods of White House-declared "emergency," this bill mandates that private-sector networks only be managed by government-licensed "cybersecurity professionals."

If  you think dealing with your office IT department is bad now, just wait until  they're federally-licensed bureaucrats.

And God forbid you like to visit websites that spread "fishy disinformation" like free-market healthcare solutions; passing socialized medicine could soon become enough of an "emergency" for Barack Obama to shut them down.

You know, for the public  good.

Well I know I like writing to you, and I hope you like hearing from  me.

Or if not me, at least you probably like staying in touch with your family and friends, and having access to uncensored news and current events.

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE; TABLE OF CONTENTS.

(a) SHORT TITLE- This Act may be cited as the `Cybersecurity Act of 2009'.

SEC. 2. FINDINGS.

The Congress finds the following:

(1) America's failure to protect cyberspace is one of the most urgent national security problems facing the country.

(2) Since intellectual property is now often stored in digital form, industrial espionage that exploits weak cybersecurity dilutes our investment in innovation while subsidizing the research and development efforts of foreign competitors. In the new global competition, where economic strength and technological leadership are vital components of national power, failing to secure cyberspace puts us at a disadvantage.

(3) According to the 2009 Annual Threat Assessment, `a successful cyber attack against a major financial service provider could severely impact the national economy, while cyber attacks against physical infrastructure computer systems such as those that control power grids or oil refineries have the potential to disrupt services for hours or weeks' and that `Nation states and criminals target our government and private sector information networks to gain competitive advantage in the commercial sector.'.

(4) The Director of National Intelligence testified before the Congress on February 19, 2009, that `a growing array of state and non-state adversaries are increasingly targeting-for exploitation and potentially disruption or destruction-our information infrastructure, including the Internet, telecommunications networks, computer systems, and embedded processors and controllers in critical industries' and these trends are likely to continue.

(5) John Brennan, the Assistant to the President for Homeland Security and Counterterrorism wrote on March 2, 2009, that `our nation's security and economic prosperity depend on the security, stability, and integrity of communications and information infrastructure that are largely privately-owned and globally-operated.'.

(6) Paul Kurtz, a Partner and chief operating officer of Good Harbor Consulting as well as a senior advisor to the Obama Transition Team for cybersecurity, recently stated that the United States is unprepared to respond to a `cyber-Katrina' and that `a massive cyber disruption could have a cascading, long-term impact without adequate co-ordination between government and the private sector.'.

(7) The Cyber Strategic Inquiry 2008, sponsored by Business Executives for National Security and executed by Booz Allen Hamilton, recommended to `establish a single voice for cybersecurity within government' concluding that the `unique nature of cybersecurity requires a new leadership paradigm.'.

(8) Alan Paller, the Director of Research at the SANS Institute, testified before the Congress that `the fight against cybercrime resembles an arms race where each time the defenders build a new wall, the attackers create new tools to scale the wall. What is particularly important in this analogy is that, unlike conventional warfare where deployment takes time and money and is quite visible, in the cyber world, when the attackers find a new weapon, they can attack millions of computers, and successfully infect hundreds of thousands, in a few hours or days, and remain completely hidden.'.

(9) According to the February 2003 National Strategy to Secure Cyberspace, `our nation's critical infrastructures are composed of public and private institutions in the sectors of agriculture, food, water, public health, emergency services, government, defense industrial base, information and telecommunications, energy, transportation, banking finance, chemicals and hazardous materials, and postal and shipping. Cyberspace is their nervous system--the control system of our country' and that `the cornerstone of America's cyberspace security strategy is and will remain a public-private partnership.'.

(10) According to the National Journal, Mike McConnell, the former Director of National Intelligence, told President Bush in May 2007 that if the 9/11 attackers had chosen computers instead of airplanes as their weapons and had waged a massive assault on a U.S. bank, the economic consequences would have been `an order of magnitude greater' than those cased by the physical attack on the World Trade Center. Mike McConnell has subsequently referred to cybersecurity as the `soft underbelly of this country.'.

(11) The Center for Strategic and International Studies report on Cybersecurity for the 44th Presidency concluded that (A) cybersecurity is now a major national security problem for the United States, (B) decisions and actions must respect privacy and civil liberties, and (C) only a comprehensive national security strategy that embraces both the domestic and international aspects of cybersecurity will make us more secure. The report continued stating that the United States faces `a long-term challenge in cyberspace from foreign intelligence agencies and militaries, criminals, and others, and that losing this struggle will wreak serious damage on the economic health and national security of the United States.'.

(12) James Lewis, Director and Senior Fellow, Technology and Public Policy Program, Center for Strategic and International Studies, testified on behalf of the Center for Strategic and International Studies that `the United States is not organized and lacks a coherent national strategy for addressing' cybersecurity.

(13) President Obama said in a speech at Purdue University on July 16, 2008, that `every American depends--directly or indirectly--on our system of information networks. They are increasingly the backbone of our economy and our infrastructure; our national security and our personal well-being. But it's no secret that terrorists could use our computer networks to deal us a crippling blow. We know that cyber-espionage and common crime is already on the rise. And yet while countries like China have been quick to recognize this change, for the last eight years we have been dragging our feet.' Moreover, President Obama stated that `we need to build the capacity to identify, isolate, and respond to any cyber-attack.'.

(14) The President's Information Technology Advisory Committee reported in 2005 that software is a major vulnerability and that `software development methods that have been the norm fail to provide the high-quality, reliable, and secure software that the IT infrastructure requires. . . . Today, as with cancer, vulnerable software can be invaded and modified to cause damage to previously healthy software, and infected software can replicate itself and be carried across networks to cause damage in other systems.'.

SEC. 3. CYBERSECURITY ADVISORY PANEL.

(a) IN GENERAL- The President shall establish or designate a Cybersecurity Advisory Panel.

(b) QUALIFICATIONS- The President--

(1) shall appoint as members of the panel representatives of industry, academic, non-profit organizations, interest groups and advocacy organizations, and State and local governments who are qualified to provide advice and information on cybersecurity research, development, demonstrations, education, technology transfer, commercial application, or societal and civil liberty concerns; and

(2) may seek and give consideration to recommendations from the Congress, industry, the cybersecurity community, the defense community, State and local governments, and other appropriate organizations.

(c) DUTIES- The panel shall advise the President on matters relating to the national cybersecurity program and strategy and shall assess--

(1) trends and developments in cybersecurity science research and development;

(2) progress made in implementing the strategy;

(3) the need to revise the strategy;

(4) the balance among the components of the national strategy, including funding for program components;

(5) whether the strategy, priorities, and goals are helping to maintain United States leadership and defense in cybersecurity;

(6) the management, coordination, implementation, and activities of the strategy; and

(7) whether societal and civil liberty concerns are adequately addressed.

(d) REPORTS- The panel shall report, not less frequently than once every 2 years, to the President on its assessments under subsection (c) and its recommendations for ways to improve the strategy.

(e) TRAVEL EXPENSES OF NON-FEDERAL MEMBERS- Non-Federal members of the panel, while attending meetings of the panel or while otherwise serving at the request of the head of the panel while away from their homes or regular places of business, may be allowed travel expenses, including per diem in lieu of subsistence, as authorized by section 5703 of title 5, United States Code, for individuals in the government serving without pay. Nothing in this subsection shall be construed to prohibit members of the panel who are officers or employees of the United States from being allowed travel expenses, including per diem in lieu of subsistence, in accordance with law.

(f) EXEMPTION FROM FACA SUNSET- Section 14 of the Federal Advisory Committee Act (5 U.S.C. App.) shall not apply to the Advisory Panel.

SEC. 4. REAL-TIME CYBERSECURITY DASHBOARD.

The Secretary of Commerce shall--

(1) in consultation with the Office of Management and Budget, develop a plan within 90 days after the date of enactment of this Act to implement a system to provide dynamic, comprehensive, real-time cybersecurity status and vulnerability information of all Federal Government information systems and networks managed by the Department of Commerce; and

(2) implement the plan within 1 year after the date of enactment of this Act.

SEC. 5. STATE AND REGIONAL CYBERSECURITY ENHANCEMENT PROGRAM.

(a) CREATION AND SUPPORT OF CYBERSECURITY CENTERS- The Secretary of Commerce shall provide assistance for the creation and support of Regional Cybersecurity Centers for the promotion and implementation of cybersecurity standards. Each Center shall be affiliated with a United States-based nonprofit institution or organization, or consortium thereof, that applies for and is awarded financial assistance under this section.

(b) PURPOSE- The purpose of the Centers is to enhance the cybersecurity of small and medium sized businesses in United States through--

(1) the transfer of cybersecurity standards, processes, technology, and techniques developed at the National Institute of Standards and Technology to Centers and, through them, to small- and medium-sized companies throughout the United States;

(2) the participation of individuals from industry, universities, State governments, other Federal agencies, and, when appropriate, the Institute in cooperative technology transfer activities;

(3) efforts to make new cybersecurity technology, standards, and processes usable by United States-based small- and medium-sized companies;

(4) the active dissemination of scientific, engineering, technical, and management information about cybersecurity to industrial firms, including small- and medium-sized companies; and

(5) the utilization, when appropriate, of the expertise and capability that exists in Federal laboratories other than the Institute.

(1) disseminate cybersecurity technologies, standard, and processes based on research by the Institute for the purpose of demonstrations and technology transfer;

(2) actively transfer and disseminate cybersecurity strategies, best practices, standards, and technologies to protect against and mitigate the risk of cyber attacks to a wide range of companies and enterprises, particularly small- and medium-sized businesses; and

(3) make loans, on a selective, short-term basis, of items of advanced cybersecurity countermeasures to small businesses with less than 100 employees.

(1) FINANCIAL SUPPORT- The Secretary may provide financial support, not to exceed 50 percent of its annual operating and maintenance costs, to any Center for a period not to exceed 6 years (except as provided in paragraph (5)(D)).

(2) PROGRAM DESCRIPTION- Within 90 days after the date of enactment of this Act, the Secretary shall publish in the Federal Register a draft description of a program for establishing Centers and, after a 30-day comment period, shall publish a final description of the program. The description shall include--

(A) a description of the program;

(B) procedures to be followed by applicants;

(D) criteria, including those described in paragraph (4), for choosing recipients of financial assistance under this section from among the qualified applicants; and

(E) maximum support levels expected to be available to Centers under the program in the fourth through sixth years of assistance under this section.

(3) APPLICATIONS; SUPPORT COMMITMENT- Any nonprofit institution, or consortia of nonprofit institutions, may submit to the Secretary an application for financial support under this section, in accordance with the procedures established by the Secretary. In order to receive assistance under this section, an applicant shall provide adequate assurances that it will contribute 50 percent or more of the proposed Center's annual operating and maintenance costs for the first 3 years and an increasing share for each of the next 3 years.

(4) AWARD CRITERIA- Awards shall be made on a competitive, merit-based review. In making a decision whether to approve an application and provide financial support under this section, the Secretary shall consider, at a minimum--

(A) the merits of the application, particularly those portions of the application regarding technology transfer, training and education, and adaptation of cybersecurity technologies to the needs of particular industrial sectors;

(B) the quality of service to be provided;

(D) the percentage of funding and amount of in-kind commitment from other sources.

(5) Third year evaluation-

(A) IN GENERAL- Each Center which receives financial assistance under this section shall be evaluated during its third year of operation by an evaluation panel appointed by the Secretary.

(B) EVALUATION PANEL- Each evaluation panel shall be composed of private experts, none of whom shall be connected with the involved Center, and Federal officials. An official of the Institute shall chair the panel. Each evaluation panel shall measure the Center's performance against the objectives specified in this section.

(C) POSITIVE EVALUATION REQUIRED FOR CONTINUED FUNDING- The Secretary may not provide funding for the fourth through the sixth years of a Center's operation unless the evaluation by the evaluation panel is positive. If the evaluation is positive, the Secretary may provide continued funding through the sixth year at declining levels.

(D) FUNDING AFTER SIXTH YEAR- After the sixth year, the Secretary may provide additional financial support to a Center if it has received a positive evaluation through an independent review, under procedures established by the Institute. An additional independent review shall be required at least every 2 years after the sixth year of operation. Funding received for a fiscal year under this section after the sixth year of operation may not exceed one third of the annual operating and maintenance costs of the Center.

(6) PATENT RIGHTS TO INVENTIONS- The provisions of chapter 18 of title 35, United States Code, shall (to the extent not inconsistent with this section) apply to the promotion of technology from research by Centers under this section except for contracts for such specific technology extension or transfer services as may be specified by statute or by the President, or the President's designee.

(d) ACCEPTANCE OF FUNDS FROM OTHER FEDERAL DEPARTMENTS AND AGENCIES- In addition to such sums as may be authorized and appropriated to the Secretary and President, or the President's designee, to operate the Centers program, the Secretary and the President, or the President's designee, also may accept funds from other Federal departments and agencies for the purpose of providing Federal funds to support Centers. Any Center which is supported with funds which originally came from other Federal departments and agencies shall be selected and operated according to the provisions of this section.

SEC. 6. NIST STANDARDS DEVELOPMENT AND COMPLIANCE.

(a) IN GENERAL- Within 1 year after the date of enactment of this Act, the National Institute of Standards and Technology shall establish measurable and auditable cybersecurity standards for all Federal Government, government contractor, or grantee critical infrastructure information systems and networks in the following areas:

(1) CYBERSECURITY METRICS RESEARCH- The Director of the National Institute of Standards and Technology shall establish a research program to develop cybersecurity metrics and benchmarks that can assess the economic impact of cybersecurity. These metrics should measure risk reduction and the cost of defense. The research shall include the development automated tools to assess vulnerability and compliance.

(2) SECURITY CONTROLS- The Institute shall establish standards for continuously measuring the effectiveness of a prioritized set of security controls that are known to block or mitigate known attacks.

(3) SOFTWARE SECURITY- The Institute shall establish standards for measuring the software security using a prioritized list of software weaknesses known to lead to exploited and exploitable vulnerabilities. The Institute will also establish a separate set of such standards for measuring security in embedded software such as that found in industrial control systems.

(4) SOFTWARE CONFIGURATION SPECIFICATION LANGUAGE- The Institute shall, establish standard computer-readable language for completely specifying the configuration of software on computer systems widely used in the Federal Government, by government contractors and grantees, and in private sector owned critical infrastructure information systems and networks.

(5) STANDARD SOFTWARE CONFIGURATION- The Institute shall establish standard configurations consisting of security settings for operating system software and software utilities widely used in the Federal Government, by government contractors and grantees, and in private sector owned critical infrastructure information systems and networks.

(6) VULNERABILITY SPECIFICATION LANGUAGE- The Institute shall establish standard computer-readable language for specifying vulnerabilities in software to enable software vendors to communicate vulnerability data to software users in real time.

(7) National compliance standards for all software-

(A) PROTOCOL- The Institute shall establish a standard testing and accreditation protocol for software built by or for the Federal Government, its contractors, and grantees, and private sector owned critical infrastructure information systems and networks. to ensure that it--

(i) meets the software security standards of paragraph (2); and

(ii) does not require or cause any changes to be made in the standard configurations described in paragraph (4).

(B) COMPLIANCE- The Institute shall develop a process or procedure to verify that--

(i) software development organizations comply with the protocol established under subparagraph (A) during the software development process; and

(ii) testing results showing evidence of adequate testing and defect reduction are provided to the Federal Government prior to deployment of software.

(b) CRITERIA FOR STANDARDS- Notwithstanding any other provision of law (including any Executive Order), rule, regulation, or guideline, in establishing standards under this section, the Institute shall disregard the designation of an information system or network as a national security system or on the basis of presence of classified or confidential information, and shall establish standards based on risk profiles.

(c) INTERNATIONAL STANDARDS- The Director, through the Institute and in coordination with appropriate Federal agencies, shall be responsible for United States representation in all international standards development related to cybersecurity, and shall develop and implement a strategy to optimize the United States position with respect to international cybersecurity standards.

(d) COMPLIANCE ENFORCEMENT- The Director shall--

(1) enforce compliance with the standards developed by the Institute under this section by software manufacturers, distributors, and vendors; and

(2) shall require each Federal agency, and each operator of an information system or network designated by the President as a critical infrastructure information system or network, periodically to demonstrate compliance with the standards established under this section.

(e) FCC NATIONAL BROADBAND PLAN- In developing the national broadband plan pursuant to section 6001(k) of the American Recovery and Reinvestment Act of 2009, the Federal Communications Commission shall report on the most effective and efficient means to ensure the cybersecurity of commercial broadband networks, including consideration of consumer education and outreach programs.

SEC. 7. LICENSING AND CERTIFICATION OF CYBERSECURITY PROFESSIONALS.

(a) IN GENERAL- Within 1 year after the date of enactment of this Act, the Secretary of Commerce shall develop or coordinate and integrate a national licensing, certification, and periodic recertification program for cybersecurity professionals.

(b) MANDATORY LICENSING- Beginning 3 years after the date of enactment of this Act, it shall be unlawful for any individual to engage in business in the United States, or to be employed in the United States, as a provider of cybersecurity services to any Federal agency or an information system or network designated by the President, or the President's designee, as a critical infrastructure information system or network, who is not licensed and certified under the program.

SEC. 8. REVIEW OF NTIA DOMAIN NAME CONTRACTS.

(a) IN GENERAL- No action by the Assistant Secretary of Commerce for Communications and Information after the date of enactment of this Act with respect to the renewal or modification of a contract related to the operation of the Internet Assigned Numbers Authority, shall be final until the Advisory Panel--

(1) has reviewed the action;

(2) considered the commercial and national security implications of the action; and

(3) approved the action.

(b) APPROVAL PROCEDURE- If the Advisory Panel does not approve such an action, it shall immediately notify the Assistant Secretary in writing of the disapproval and the reasons therefor. The Advisory Panel may provide recommendations to the Assistant Secretary in the notice for any modifications the it deems necessary to secure approval of the action.

SEC. 9. SECURE DOMAIN NAME ADDRESSING SYSTEM.

(a) IN GENERAL- Within 3 years after the date of enactment of this Act, the Assistant Secretary of Commerce for Communications and Information shall develop a strategy to implement a secure domain name addressing system. The Assistant Secretary shall publish notice of the system requirements in the Federal Register together with an implementation schedule for Federal agencies and information systems or networks designated by the President, or the President's designee, as critical infrastructure information systems or networks.

(b) COMPLIANCE REQUIRED- The President shall ensure that each Federal agency and each such system or network implements the secure domain name addressing system in accordance with the schedule published by the Assistant Secretary.

SEC. 10. PROMOTING CYBERSECURITY AWARENESS.

The Secretary of Commerce shall develop and implement a national cybersecurity awareness campaign that--

(1) is designed to heighten public awareness of cybersecurity issues and concerns;

(2) communicates the Federal Government's role in securing the Internet and protecting privacy and civil liberties with respect to Internet-related activities; and

(3) utilizes public and private sector means of providing information to the public, including public service announcements.

SEC. 11. FEDERAL CYBERSECURITY RESEARCH AND DEVELOPMENT.

(a) FUNDAMENTAL CYBERSECURITY RESEARCH- The Director of the National Science Foundation shall give priority to computer and information science and engineering research to ensure substantial support is provided to meet the following challenges in cybersecurity:

(1) How to design and build complex software-intensive systems that are secure and reliable when first deployed.

(2) How to test and verify that software, whether developed locally or obtained from a third party, is free of significant known security flaws.

(3) How to test and verify that software obtained from a third party correctly implements stated functionality, and only that functionality.

(4) How to guarantee the privacy of an individual's identity, information, or lawful transactions when stored in distributed systems or transmitted over networks.

(5) How to build new protocols to enable the Internet to have robust security as one of its key capabilities.

(6) How to determine the origin of a message transmitted over the Internet.

(7) How to support privacy in conjunction with improved security.

(8) How to address the growing problem of insider threat.

(b) SECURE CODING RESEARCH- The Director shall support research that evaluates selected secure coding education and improvement programs. The Director shall also support research on new methods of integrating secure coding improvement into the core curriculum of computer science programs and of other programs where graduates have a substantial probability of developing software after graduation.

(c) ASSESSMENT OF SECURE CODING EDUCATION IN COLLEGES AND UNIVERSITIES- Within one year after the date of enactment of this Act, the Director shall submit to the Senate Committee on Commerce, Science, and Transportation and the House of Representatives Committee on Science and Technology a report on the state of secure coding education in America's colleges and universities for each school that received National Science Foundation funding in excess of $1,000,000 during fiscal year 2008. The report shall include--

(1) the number of students who earned undergraduate degrees in computer science or in each other program where graduates have a substantial probability of being engaged in software design or development after graduation;

(2) the percentage of those students who completed substantive secure coding education or improvement programs during their undergraduate experience; and

(3) descriptions of the length and content of the education and improvement programs, and a measure of the effectiveness of those programs in enabling the students to master secure coding and design.

(d) CYBERSECURITY MODELING AND TESTBEDS- The Director shall establish a program to award grants to institutions of higher education to establish cybersecurity testbeds capable of realistic modeling of real-time cyber attacks and defenses. The purpose of this program is to support the rapid development of new cybersecurity defenses, techniques, and processes by improving understanding and assessing the latest technologies in a real-world environment. The testbeds shall be sufficiently large in order to model the scale and complexity of real world networks and environments.

(e) NSF COMPUTER AND NETWORK SECURITY RESEARCH GRANT AREAS- Section 4(a)(1) of the Cybersecurity Research and Development Act (15 U.S.C. 7403(a)(1)) is amended--

(1) by striking `and' after the semicolon in subparagraph (H);

(2) by striking `property.' in subparagraph (I) and inserting `property;'; and

(3) by adding at the end the following:

`(J) secure fundamental protocols that are at the heart of inter-network communications and data exchange;

`(K) secure software engineering and software assurance, including--

`(i) programming languages and systems that include fundamental security features;

`(ii) portable or reusable code that remains secure when deployed in various environments;

`(iii) verification and validation technologies to ensure that requirements and specifications have been implemented; and

`(iv) models for comparison and metrics to assure that required standards have been met;

`(L) holistic system security that--

`(i) addresses the building of secure systems from trusted and untrusted components;

`(ii) proactively reduces vulnerabilities;

`(iii) addresses insider threats; and

`(iv) supports privacy in conjunction with improved security;

`(M) monitoring and detection; and

`(N) mitigation and rapid recovery methods.'.

(f) NSF COMPUTER AND NETWORK SECURITY GRANTS- Section 4(a)(3) of the Cybersecurity Research and Development Act (15 U.S.C. 7403(a)(3)) is amended--

(1) by striking `and' in subparagraph (D);

(2) by striking `2007' in subparagraph (E) and inserting `2007;'; and

(3) by adding at the end of the following:

`(F) $150,000,000 for fiscal year 2010;

`(G) $155,000,000 for fiscal year 2011;

`(H) $160,000,000 for fiscal year 2012;

`(I) $165,000,000 for fiscal year 2013; and

`(J) $170,000,000 for fiscal year 2014.'.

(g) COMPUTER AND NETWORK SECURITY CENTERS- Section 4(b)(7) of such Act (15 U.S.C. 7403(b)(7)) is amended--

(1) by striking `and' in subparagraph (D);

(2) by striking `2007' in subparagraph (E) and inserting `2007;'; and

(3) by adding at the end of the following:

`(F) $50,000,000 for fiscal year 2010;

`(G) $52,000,000 for fiscal year 2011;

`(H) $54,000,000 for fiscal year 2012;

`(I) $56,000,000 for fiscal year 2013; and

`(J) $58,000,000 for fiscal year 2014.'.

(h) COMPUTER AND NETWORK SECURITY CAPACITY BUILDING GRANTS- Section 5(a)(6) of such Act (15 U.S.C. 7404(a)(6)) is amended--

(1) by striking `and' in subparagraph (D);

(2) by striking `2007' in subparagraph (E) and inserting `2007;'; and

(3) by adding at the end of the following:

`(F) $40,000,000 for fiscal year 2010;

`(G) $42,000,000 for fiscal year 2011;

`(H) $44,000,000 for fiscal year 2012;

`(I) $46,000,000 for fiscal year 2013; and

`(J) $48,000,000 for fiscal year 2014.'.

(i) SCIENTIFIC AND ADVANCED TECHNOLOGY ACT GRANTS- Section 5(b)(2) of such Act (15 U.S.C. 7404(b)(2)) is amended--

(1) by striking `and' in subparagraph (D);

(2) by striking `2007' in subparagraph (E) and inserting `2007;'; and

(3) by adding at the end of the following:

`(F) $5,000,000 for fiscal year 2010;

`(G) $6,000,000 for fiscal year 2011;

`(H) $7,000,000 for fiscal year 2012;

`(I) $8,000,000 for fiscal year 2013; and

`(J) $9,000,000 for fiscal year 2014.'.

(j) GRADUATE TRAINEESHIPS IN COMPUTER AND NETWORK SECURITY RESEARCH- Section 5(c)(7) of such Act (15 U.S.C. 7404(c)(7)) is amended--

(1) by striking `and' in subparagraph (D);

(2) by striking `2007' in subparagraph (E) and inserting `2007;'; and

(3) by adding at the end of the following:

`(F) $20,000,000 for fiscal year 2010;

`(G) $22,000,000 for fiscal year 2011;

`(H) $24,000,000 for fiscal year 2012;

`(I) $26,000,000 for fiscal year 2013; and

`(J) $28,000,000 for fiscal year 2014.'.

(k) CYBERSECURITY FACULTY DEVELOPMENT TRAINEESHIP PROGRAM- Section 5(e)(9) of such Act (15 U.S.C. 7404(e)(9)) is amended by striking `2007.' and inserting `2007 and for each of fiscal years 2010 through 2014.'.

(l) NETWORKING AND INFORMATION TECHNOLOGY RESEARCH AND DEVELOPMENT PROGRAM- Section 204(a)(1) of the High-Performance Computing Act of 1991 (15 U.S.C. 5524(a)(1)) is amended--

(1) by striking `and' after the semicolon in subparagraph (B); and

(2) by inserting after subparagraph (C) the following:

`(D) develop and propose standards and guidelines, and develop measurement techniques and test methods, for enhanced cybersecurity for computer networks and common user interfaces to systems; and'.

SEC. 12. FEDERAL CYBER SCHOLARSHIP-FOR-SERVICE PROGRAM.

(a) IN GENERAL- The Director of the National Science Foundation shall establish a Federal Cyber Scholarship-for-Service program to recruit and train the next generation of Federal information technology workers and security managers.

(b) PROGRAM DESCRIPTION AND COMPONENTS- The program--

(1) shall provide scholarships, that provide full tuition, fees, and a stipend, for up to 1,000 students per year in their pursuit of undergraduate or graduate degrees in the cybersecurity field;

(2) shall require scholarship recipients, as a condition of receiving a scholarship under the program, to agree to serve in the Federal information technology workforce for a period equal to the length of the scholarship following graduation if offered employment in that field by a Federal agency;

(3) shall provide opportunities for students to receive temporary appointments for meaningful employment in the Federal information technology workforce during school vacation periods and for internships;

(4) shall provide a procedure for identifying promising K-12 students for participation in summer work and internship programs that would lead to certification of Federal information technology workforce standards and possible future employment; and

(5) shall examine and develop, if appropriate, programs to promote computer security awareness in secondary and high school classrooms.

(c) HIRING AUTHORITY- For purposes of any law or regulation governing the appointment of individuals in the Federal civil service, upon the successful completion of their studies, students receiving a scholarship under the program shall be hired under the authority provided for in section 213.3102(r) of title 5, Code of Federal Regulations, and be exempt from competitive service. Upon fulfillment of the service term, such individuals shall be converted to a competitive service position without competition if the individual meets the requirements for that position.

(d) ELIGIBILITY- To be eligible to receive a scholarship under this section, an individual shall--

(1) be a citizen of the United States; and

(2) demonstrate a commitment to a career in improving the Nation's cyber defenses.

(e) CONSIDERATION AND PREFERENCE- In making selections for scholarships under this section, the Director shall--

(1) consider, to the extent possible, a diverse pool of applicants whose interests are of an interdisciplinary nature, encompassing the social scientific as well as the technical dimensions of cyber security; and

(2) give preference to applicants that have participated in the competition and challenge described in section 13.

(f) EVALUATION AND REPORT- The Director shall evaluate and report to the Senate Committee on Commerce, Science, and Transportation and the House of Representatives Committee on Science and Technology on the success of recruiting individuals for the scholarships.

(g) AUTHORIZATION OF APPROPRIATIONS- There are authorized to be appropriated to the National Science Foundation to carry out this section--

(1) $50,000,000 for fiscal year 2010;

(2) $55,000,000 for fiscal year 2011;

(3) $60,000,000 for fiscal year 2012;

(4) $65,000,000 for fiscal year 2013; and

(5) $70,000,000 for fiscal year 2014.

SEC. 13. CYBERSECURITY COMPETITION AND CHALLENGE.

(a) IN GENERAL- The Director of the National Institute of Standards and Technology, directly or through appropriate Federal entities, shall establish cybersecurity competitions and challenges with cash prizes in order to--

(1) attract, identify, evaluate, and recruit talented individuals for the Federal information technology workforce; and

(2) stimulate innovation in basic and applied cybersecurity research, technology development, and prototype demonstration that have the potential for application to the Federal information technology activities of the Federal Government.

(b) TYPES OF COMPETITIONS AND CHALLENGES- The Director shall establish different competitions and challenges targeting the following groups:

(1) High school students.

(2) Undergraduate students.

(3) Graduate students.

(4) Academic and research institutions.

(c) TOPICS- In selecting topics for prize competitions, the Director shall consult widely both within and outside the Federal Government, and may empanel advisory committees.

(d) ADVERTISING- The Director shall widely advertise prize competitions, in coordination with the awareness campaign under section 10, to encourage participation.

(e) REQUIREMENTS AND REGISTRATION- For each prize competition, the Director shall publish a notice in the Federal Register announcing the subject of the competition, the rules for being eligible to participate in the competition, the amount of the prize, and the basis on which a winner will be selected.

(f) ELIGIBILITY- To be eligible to win a prize under this section, an individual or entity--

(1) shall have registered to participate in the competition pursuant to any rules promulgated by the Director under subsection (d);

(2) shall have complied with all the requirements under this section;

(3) in the case of a private entity, shall be incorporated in and maintain a primary place of business in the United States, and in the case of an individual, whether participating singly or in a group, shall be a citizen or permanent resident of the United States; and

(4) shall not be a Federal entity or Federal employee acting within the scope of his or her employment.

(g) JUDGES- For each competition, the Director, either directly or through an agreement under subsection (h), shall assemble a panel of qualified judges to select the winner or winners of the prize competition. Judges for each competition shall include individuals from the private sector. A judge may not--

(1) have personal or financial interests in, or be an employee, officer, director, or agent of any entity that is a registered participant in a competition; or

(2) have a familial or financial relationship with an individual who is a registered participant.

(h) ADMINISTERING THE COMPETITION- The Director may enter into an agreement with a private, nonprofit entity to administer the prize competition, subject to the provisions of this section.

(i) Funding-

(1) PRIZES- Prizes under this section may consist of Federal appropriated funds and funds provided by the private sector for such cash prizes. The Director may accept funds from other Federal agencies for such cash prizes. The Director may not give special consideration to any private sector entity in return for a donation.

(2) USE OF UNEXPENDED FUNDS- Notwithstanding any other provision of law, funds appropriated for prize awards under this section shall remain available until expended, and may be transferred, reprogrammed, or expended for other purposes only after the expiration of 10 fiscal years after the fiscal year for which the funds were originally appropriated. No provision in this section permits obligation or payment of funds in violation of the Anti-Deficiency Act (31 U.S.C. 1341).

(3) FUNDING REQUIRED BEFORE PRIZE ANNOUNCED- No prize may be announced until all the funds needed to pay out the announced amount of the prize have been appropriated or committed in writing by a private source. The Director may increase the amount of a prize after an initial announcement is made under subsection (d) if--

(A) notice of the increase is provided in the same manner as the initial notice of the prize; and

(B) the funds needed to pay out the announced amount of the increase have been appropriated or committed in writing by a private source.

(4) NOTICE REQUIRED FOR LARGE AWARDS- No prize competition under this section may offer a prize in an amount greater than $5,000,000 unless 30 days have elapsed after written notice has been transmitted to the Senate Committee on Commerce, Science, and Transportation and the House of Representatives Committee on Science and Technology.

(5) DIRECTOR'S APPROVAL REQUIRED FOR CERTAIN AWARDS- No prize competition under this section may result in the award of more than $1,000,000 in cash prizes without the approval of the Director.

(j) USE OF FEDERAL INSIGNIA- A registered participant in a competition under this section may use any Federal agency's name, initials, or insignia only after prior review and written approval by the Director.

(k) COMPLIANCE WITH EXISTING LAW- The Federal Government shall not, by virtue of offering or providing a prize under this section, be responsible for compliance by registered participants in a prize competition with Federal law, including licensing, export control, and non-proliferation laws and related regulations.

(l) AUTHORIZATION OF APPROPRIATIONS- There are authorized to be appropriated to the National Institute of Standards and Technology to carry out this section $15,000,000 for each of fiscal years 2010 through 2014.

SEC. 14. PUBLIC-PRIVATE CLEARINGHOUSE.

(a) DESIGNATION- The Department of Commerce shall serve as the clearinghouse of cybersecurity threat and vulnerability information to Federal Government and private sector owned critical infrastructure information systems and networks.

(b) FUNCTIONS- The Secretary of Commerce--

(1) shall have access to all relevant data concerning such networks without regard to any provision of law, regulation, rule, or policy restricting such access;

(2) shall manage the sharing of Federal Government and other critical infrastructure threat and vulnerability information between the Federal Government and the persons primarily responsible for the operation and maintenance of the networks concerned; and

(3) shall report regularly to the Congress on threat information held by the Federal Government that is not shared with the persons primarily responsible for the operation and maintenance of the networks concerned.

(c) INFORMATION SHARING RULES AND PROCEDURES- Within 90 days after the date of enactment of this Act, the Secretary shall publish in the Federal Register a draft description of rules and procedures on how the Federal Government will share cybersecurity threat and vulnerability information with private sector critical infrastructure information systems and networks owners. After a 30 day comment period, the Secretary shall publish a final description of the rules and procedures. The description shall include--

(1) the rules and procedures on how the Federal Government will share cybersecurity threat and vulnerability information with private sector critical infrastructure information systems and networks owners;

(2) the criteria in which private sector owners of critical infrastructure information systems and networks shall share actionable cybersecurity threat and vulnerability information and relevant data with the Federal Government; and

(3) any other rule or procedure that will enhance the sharing of cybersecurity threat and vulnerability information between private sector owners of critical infrastructure information systems and networks and the Federal Government.

SEC. 15. CYBERSECURITY RISK MANAGEMENT REPORT.

Within 1 year after the date of enactment of this Act, the President, or the President's designee, shall report to the Senate Committee on Commerce, Science, and Transportation and the House of Representatives Committee on Science and Technology on the feasibility of--

(1) creating a market for cybersecurity risk management, including the creation of a system of civil liability and insurance (including government reinsurance); and

(2) requiring cybersecurity to be a factor in all bond ratings.

SEC. 16. LEGAL FRAMEWORK REVIEW AND REPORT.

(a) IN GENERAL- Within 1 year after the date of enactment of this Act, the President, or the President's designee, through an appropriate entity, shall complete a comprehensive review of the Federal statutory and legal framework applicable to cyber-related activities in the United States, including--

(1) the Privacy Protection Act of 1980 (42 U.S.C. 2000aa);

(2) the Electronic Communications Privacy Act of 1986 (18 U.S.C. 2510 note);

(3) the Computer Security Act of 1987 (15 U.S.C. 271 et seq.; 40 U.S.C. 759);

(4) the Federal Information Security Management Act of 2002 (44 U.S.C. 3531 et seq.);

(5) the E-Government Act of 2002 (44 U.S.C. 9501 et seq.);

(6) the Defense Production Act of 1950 (50 U.S.C. App. 2061 et seq.);

(7) any other Federal law bearing upon cyber-related activities; and

(8) any applicable Executive Order or agency rule, regulation, guideline.

(b) REPORT- Upon completion of the review, the President, or the President's designee, shall submit a report to the Senate Committee on Commerce, Science, and Transportation, the House of Representatives Committee on Science and Technology, and other appropriate Congressional Committees containing the President's, or the President's designee's, findings, conclusions, and recommendations.

SEC. 17. AUTHENTICATION AND CIVIL LIBERTIES REPORT.

Within 1 year after the date of enactment of this Act, the President, or the President's designee, shall review, and report to Congress, on the feasibility of an identity management and authentication program, with the appropriate civil liberties and privacy protections, for government and critical infrastructure information systems and networks.

SEC. 18. CYBERSECURITY RESPONSIBILITIES AND AUTHORITY.

The President--

(1) within 1 year after the date of enactment of this Act, shall develop and implement a comprehensive national cybersecurity strategy, which shall include--

(A) a long-term vision of the Nation's cybersecurity future; and

(B) a plan that encompasses all aspects of national security, including the participation of the private sector, including critical infrastructure operators and managers;

(2) may declare a cybersecurity emergency and order the limitation or shutdown of Internet traffic to and from any compromised Federal Government or United States critical infrastructure information system or network;

(3) shall designate an agency to be responsible for coordinating the response and restoration of any Federal Government or United States critical infrastructure information system or network affected by a cybersecurity emergency declaration under paragraph (2);

(4) shall, through the appropriate department or agency, review equipment that would be needed after a cybersecurity attack and develop a strategy for the acquisition, storage, and periodic replacement of such equipment;

(5) shall direct the periodic mapping of Federal Government and United States critical infrastructure information systems or networks, and shall develop metrics to measure the effectiveness of the mapping process;

(6) may order the disconnection of any Federal Government or United States critical infrastructure information systems or networks in the interest of national security;

(7) shall, through the Office of Science and Technology Policy, direct an annual review of all Federal cyber technology research and development investments;

(8) may delegate original classification authority to the appropriate Federal official for the purposes of improving the Nation's cybersecurity posture;

(9) shall, through the appropriate department or agency, promulgate rules for Federal professional responsibilities regarding cybersecurity, and shall provide to the Congress an annual report on Federal agency compliance with those rules;

(10) shall withhold additional compensation, direct corrective action for Federal personnel, or terminate a Federal contract in violation of Federal rules, and shall report any such action to the Congress in an unclassified format within 48 hours after taking any such action; and

(11) shall notify the Congress within 48 hours after providing a cyber-related certification of legality to a United States person.

SEC. 19. QUADRENNIAL CYBER REVIEW.

(a) IN GENERAL- Beginning with 2013 and in every fourth year thereafter, the President, or the President's designee, shall complete a review of the cyber posture of the United States, including an unclassified summary of roles, missions, accomplishments, plans, and programs. The review shall include a comprehensive examination of the cyber strategy, force structure, modernization plans, infrastructure, budget plan, the Nation's ability to recover from a cyberemergency, and other elements of the cyber program and policies with a view toward determining and expressing the cyber strategy of the United States and establishing a revised cyber program for the next 4 years.

(b) INVOLVEMENT OF CYBERSECURITY ADVISORY PANEL-

(1) The President, or the President's designee, shall apprise the Cybersecurity Advisory Panel established or designated under section 3, on an ongoing basis, of the work undertaken in the conduct of the review.

(2) Not later than 1 year before the completion date for the review, the Chairman of the Advisory Panel shall submit to the President, or the President's designee, the Panel's assessment of work undertaken in the conduct of the review as of that date and shall include in the assessment the recommendations of the Panel for improvements to the review, including recommendations for additional matters to be covered in the review.

(c) ASSESSMENT OF REVIEW- Upon completion of the review, the Chairman of the Advisory Panel, on behalf of the Panel, shall prepare and submit to the President, or the President's designee, an assessment of the review in time for the inclusion of the assessment in its entirety in the report under subsection (d).

(d) REPORT- Not later than September 30, 2013, and every 4 years thereafter, the President, or the President's designee, shall submit to the relevant congressional Committees a comprehensive report on the review. The report shall include--

(1) the results of the review, including a comprehensive discussion of the cyber strategy of the United States and the collaboration between the public and private sectors best suited to implement that strategy;

(2) the threats examined for purposes of the review and the scenarios developed in the examination of such threats;

(3) the assumptions used in the review, including assumptions relating to the cooperation of other countries and levels of acceptable risk; and

(4) the Advisory Panel's assessment.

SEC. 20. JOINT INTELLIGENCE THREAT ASSESSMENT.

The Director of National Intelligence and the Secretary of Commerce shall submit to the Congress an annual assessment of, and report on, cybersecurity threats to and vulnerabilities of critical national information, communication, and data network infrastructure.

SEC. 21. INTERNATIONAL NORMS AND CYBERSECURITY DETERRANCE MEASURES.

The President shall--

(1) work with representatives of foreign governments--

(A) to develop norms, organizations, and other cooperative activities for international engagement to improve cybersecurity; and

(B) to encourage international cooperation in improving cybersecurity on a global basis; and

(2) provide an annual report to the Congress on the progress of international initiatives undertaken pursuant to subparagraph (A).

SEC. 22. FEDERAL SECURE PRODUCTS AND SERVICES ACQUISITIONS BOARD.

(a) ESTABLISHMENT- There is established a Secure Products and Services Acquisitions Board. The Board shall be responsible for cybersecurity review and approval of high value products and services acquisition and, in coordination with the National Institute of Standards and Technology, for the establishment of appropriate standards for the validation of software to be acquired by the Federal Government. The Director of the National Institute of Standards and Technology shall develop the review process and provide guidance to the Board. In reviewing software under this subsection, the Board may consider independent secure software validation and verification as key factor for approval.

(b) ACQUISITION STANDARDS- The Director, in cooperation with the Office of Management and Budget and other appropriate Federal agencies, shall ensure that the Board approval is included as a prerequisite to the acquisition of any product or service--

(1) subject to review by the Board; and

(2) subject to Federal acquisition standards.

(c) ACQUISITION COMPLIANCE- After the publication of the standards developed under subsection (a), any proposal submitted in response to a request for proposals issued by a Federal agency shall demonstrate compliance with any such applicable standard in order to ensure that cybersecurity products and services are designed to be an integral part of the overall acquisition.

SEC. 23. DEFINITIONS.

In this Act:

(1) ADVISORY PANEL- The term `Advisory Panel' means the Cybersecurity Advisory Panel established or designated under section 3.

(2) CYBER- The term `cyber' means--

(A) any process, program, or protocol relating to the use of the Internet or an intranet, automatic data processing or transmission, or telecommunication via the Internet or an intranet; and

(B) any matter relating to, or involving the use of, computers or computer networks.

(3) FEDERAL GOVERNMENT AND UNITED STATES CRITICAL INFRASTRUCTURE INFORMATION SYSTEMS AND NETWORKS- The term `Federal Government and United States critical infrastructure information systems and networks' includes--

(A) Federal Government information systems and networks; and

(B) State, local, and nongovernmental information systems and networks in the United States designated by the President as critical infrastructure information systems and networks.

(4) INTERNET- The term `Internet' has the meaning given that term by section 4(4) of the High-Performance Computing Act of 1991 (15 U.S.C. 5503(4)).

(5) NETWORK- The term `network' has the meaning given that term by section 4(5) of such Act (15 U.S.C. 5503(5)).

Turn Stock Market into a Ponzi Scheme: The Easy Way

Today, Goldman Sachs comes out with an upgrade of Capital One bank and Wells Fargo.
The Banks rally 5%. Broad market rallies 1.5%.

[UPDATE: 10/18/2009 Two weeks after the revelation (below), stocks as measured by S&P 500 went straight up for 10 business days, gaining a total of 5% additionally. All conclusions below are confirmed. The only deviation I found was Bank of America reporting $2B Q3, 2009 loss, quite honest, huh. If you are still in stocks like I am, be cautioned!]

After a huge 50-60% run up of the stocks since March 12 2009, you'd think stocks are up for a correction. After the house selling Summer high, you'd expect banks are up for a rough Fall and Winter. After banks hiding their liabilities off the balance sheet a-la Enron, you'd think someday they'll have to show their 'toxic' hidden assets and account for them.

After the top contrarian trend-forecasting stars Dent, Celente, Prechter, and others are seeing an imminent downturn of the stock market, nope, it keeps going up.

But no, the day of reckoning ain't coming just yet. Why not?

I'm following the broad stock market more closely than usual because I found some extra stocks in my Roth IRA that I never sold. It's been 10 years since I seriously looked at the portfolio. It is basically all S&P 500 and guess what, it hasn't made me but a few percent profit after 10 years! Counting for true inflation, it's lost a lot.

Back to the topic. Stock Market a Ponzi Scheme? Madoff reincarnated on a huge scale? And it is easy to turn Stock Market into a Ponzi Scheme? What do you mean Matt?

For the longest time I couldn't understand why, in 2007, establishments such as Washington Mutual were still offering subprime loans to folks even though the subprime market was collapsing all around them. They are in the business of subprime loans and they don't see the calamity has already arrived? Strange. But it is possible to understand why now.

At the last week's IMF meeting, Janet Tavakoli, an expert on structured finance and derivatives, said (quote credit: prisonplanet.com):

Wall Street gave mortgage lenders large credit lines (similar to credit card debt) and packaged the loans into private-label residential mortgage backed securities (RMBS). Most of the RMBS was rated “AAA” … But many RMBSs were backed by portfolios comprising risky fraud-riddled loans. Most of the “AAA” investment was imperiled, and subordinated “investment grade” components were worthless. Wall Street disguised these toxic “investments” with new value-destroying securitizations and derivatives.

Meanwhile, collapsing mortgage lenders paid high dividends to shareholders (old investors) and interest on credit lines to Wall Street (old investors) with money raised from new investors in doomed securities. New money allowed Wall Street to temporarily hide losses and pay enormous bonuses. This is a classic Ponzi scheme…

A large share of certain banks’ tax-subsidized profits is due as reparation to unsophisticated investors, the U.S. taxpayers...By the end of 2006, public reports of implosions of large mortgage lenders eliminated CEOs’ plausible deniability. By January 2007, many (including me) publicly challenged the failure to account for losses. Instead, toxic securitization accelerated in the first half of 2007—classic malfeasance as a Ponzi scheme collapses…

Bottom line, in order to keep the Ponzi scheme running, it has to accelerate in the final stages. That is a sure sign of it being ready to collapse.

How to turn stock market into a Ponzi scheme? Easy. Couple of steps:

- Banks hide toxic assets off the balance sheets
- Mainstream Media publishes great outlook from well known names on how great the banks are doing (Goldman Sachs example, the bank books are looking great if you remove off-balance-sheet assets)
- Mainstream Media touts "Recovery"
- The FED keeps the rates at about 0% keeping bank loans expenses practically at zero
- The government allows printing of Trillions of Dollars through bailouts and stimuli packages, mostly going to the banks who turn around and play with the cash in the stock market
- The government publishes heavily doctored data on unemployment, so it doesn't look as bad as it is.

Well there are maybe a few more steps needed but you get the picture. And I can't give you more details, I'm not working at Wall Street!

Banks are "looking pretty", and "everyone knows", the way the banks go stock market goes.

However, remember, it is a Ponzi scheme. It is based on taking money from Peter and giving it to Paul. There is no value created or consumed. Eventually, this Ponzi scheme Stock Market will pop. But it may go (much) higher before it pops. And you and I won't know when that will be, because it is not you and I who are running the Scheme.

So if you are invested in a stock market, watch your investment carefully. It may rise substantially before it pops. If you have no patience and have better things to do, get out of the market and buy back at half the value or less. Or don't buy back, ever.

Shadow Inventory of Houses: Another Reason to Audit the FED

As I previously reported, September 15th is the Audit the FED Mass Action day . Here's another reason why the House and the People need to audit the Federal Reserve Bank:

Through bank bailouts and FED actions, some banks received seemingly unlimited and definitely secretive amount of interest-free funds. What banks are getting the money and what are the banks doing with this cheap capital influx?

In California, for example, it appears the banks are doing their best to hold back the inventory and create artificial shortages of housing. Take for example the Los Angeles, area. With cheap money coming in from the FED, they can afford to create a huge Shadow Inventory. Inventory not published on MLS, and not available to the general public.

Here is an example of housing prices still being unreasonably high on the LA's Westside. Here, it seems, the housing bubble is still alive and well. The rents less than a half of the mortgage for the same house:

Going one step further, the banks are playing the game of Solving the Problem of worth-less houses by Sticking Their Heads in the Sand and not doing anything about the delinquent mortgages. As Dr Housing Bubble reports this is the easiest way for them and creates a huge Shadow Inventory of houses:

Who does this kind of behavior help? Well it does "benefit" the homeowners who are behind on their mortgages live rent free and mortgage free for a while. Their stocks aren't doing badly at the moment, but for how much longer can this farce last? Would they enjoy another stock market crash in a span of just a year or so? And, finally, there are the families that have been saving money and are ready to buy a home but will not be able to for a while longer because of the artificially and continually inflated housing prices.

By auditing the FED, the people will have a clear picture of where their money is going, and how their money is being used against them in so many ways. It will become obvious why Auditing the FED means Ending the FED.

Seventy-five percent of Americans agree with us that it's time to thoroughly and completely audit the Federal Reserve System.

Last month, I announced that we would be holding an Audit the Fed Mass Action Event starting in the last couple weeks of August and culminating in a nationwide Mass Action Day on September 15.

On September 15, C4L National will deliver over 100,000 petitions to Capitol Hill while members across the country deliver the petitions they've collected to their senators' local offices. Here are three ways you can help ensure the success of this Mass Action Event:

2.) Call your senators – Starting Tuesday, September 8, C4L members will be calling their senators' offices to urge them to cosponsor S 604. 3.) Show up on September 15 - Congress counts on grassroots activists being content with just calling and sending petitions. Urgent health freedom information

A call to arms to save our food and our freedom!

Dear Friend,

The very future of organic food in the United States has come under attack. And if we don't act -- and fast -- the health of you and future generations could be permanently compromised.

Congress, in its infinite stupidity, has recently passed House Resolution 2749. This ugly bit of legislation is called the "Food Safety Enhancement Act of 2009."

Boy, is that a misnomer if I've ever heard one.

Typical of all Obama legislation, this fascist act was hurried through Congress too quickly for any lawmaker to read it (assuming any of those dolts would have bothered to try).

The farm controls mandated by this law would usher in complete government control of the food supply, and ultimately the end of organic foods. Why? Because it would give the FDA complete power to impose one-size-fits-all regulations on ALL food producers -- including independent farmers.

And because this bill also limits the amount of recourse food producers have in the courts, this means that the FDA will be able to snuff out all the foods this agency (and the influential lobbyists at whose behest this agency tends to act) it wants.

That's right: in one fell swoop, the Obama Administration is about to do away with all of pesky little state struggles being waged against organic farms and dairies, and win the war with one gigantic, fascist law.

All of those good things I've been telling you to consume more of -- raw milk, hormone- free meat, organic vegetables -- would be gone. For good.

Of course, the bill doesn't spell that out in so many words. No one would agree to it.

But since it would impose all manner of standards that would be impossible or unaffordable for small, organic farms to meet, the bill sentences organic farmers to death by paper cuts.

And those farmers guilty of even the most minor infraction of the many new regulations will feel the entire weight of the federal government crashing down upon them -- fines in the millions of dollars, and prison terms up to a staggering eight years.

The bill would even require ALL food producers to register with the FDA... for the hefty sum of $1,000!

But this hideous bill isn't a law just yet. There's still hope -- and that hope lies with you.

Help me defeat this dangerous bill

While the Food Safety Enhancement Act of 2009 has already passed the House, there's still time to be sure it doesn't get past the Senate and into range of Obama and his deadly pen.

But I can't stress this enough: the time is NOW.

As you know, I've been an outspoken proponent of organic and natural foods. As Americans, it is our right -- as well as the rights of our children and grandchildren -- to have the freedom to eat the kind of food we think is best for our health.

We must smash this attempt at complete government control of the very food we eat. And that's why I've partnered with the Natural Solution Foundation (NSF), and their efforts to kill HR 2749 in the Senate.

Since 2004, the NSF has worked toward the same goal that I write to you about each week: the support of health freedom in the United States. I think this organization is a valuable and powerful ally in this fight.

I urge you to join me and my partners at the NSF to act now to help put an end to this bill. We've already seen arrogant lawmakers made to cower before the outrage of American voters who are against the monstrous Obama healthcare reform bill. Let them hear your outrage at the Draconian restrictions of this so-called "Food Safety Act."

What I'm talking about is bigger than the vitamin D, calcium, and natural antibiotics that you'll miss when you never again have the chance to drink a glass of raw milk. It's about the freedom of small farmers here in our country, and ultimately your own freedom as well.

As I am reading the letter from the Campaign for Liberty, I can't stop wondering how all our incredible politicians (Except One, below) are unable to allow the healthcare problem to solve itself through free markets, giving control to the patients and doctors, and stop pushing socialism on the free U.S. of A.? Congress is trying to skyrocket your cost of living while putting another 1 million-plus Americans out of work. And they want to do it before the week is out.

You see, the “Cap-and-Trade” bill currently in the House is really nothing more than a thinly disguised energy tax that will hit every single American.

And now Nancy Pelosi and Congressional Democrats are pushing this tax hike toward a vote that could come as soon as Friday.

By invasively manipulating an already over-regulated energy industry, this legislation seeks to fix an alleged problem that has recently been discredited by over 31,478 scientists -- including over 3,803 with specific expertise in atmospheric, earth, and environmental sciences.

All 31,478 of these scientists are trained to understand and evaluate the scientific data relevant to the human-caused global warming hypothesis -- and are speaking out against government “remedies.”

With this bill, Congress is once again just doing what it does best -- fleecing taxpayers to further an alarmist agenda.

You see, energy companies just pass the costs of these draconian regulations through to the consumer in the form of huge price increases.

As a result, you will pay higher gas prices, higher electric prices, and higher costs for goods.

Barack Obama has estimated the costs of this legislation to American taxpayers to be over 650 BILLION dollars over the next eight years, and that figure is no doubt just a fraction of the real cost.

But even that modest estimate amounts to hundreds of dollars a year in increased living expenses for every family -- and will more likely cost thousands a year.

And according to the Heritage Foundation, between 1.2 and 2.3 million jobs could be lost over the next ten-years due to the bill’s stifling regulations.

This current economic crisis is no time for Congress to consider both raising prices on hard-working Americans AND costing them jobs.

So instead of news and action steps, we have an emergency to deal with. It is called "survival". Right now we have to tell you that we are about to lose access to our internet communication platform, Democracy in Action (DIA), the online facility that lets us send these eblasts to a quarter million people (not counting the several million more to whom they are forwarded). We also have to tell you that we cannot pay the Natural Solutions Foundation's bills for this month because of this attack. The money that we intended to pay them with has been taken from our bank account as part of the continuing attack on us, leaving us many thousands of dollars short.

We've already told you about the cyber attack we've been under, in which an "attack bot" was sending tens of thousands of fake $1 'donations' to us; and how even though we believe that their system should have caught the obviously fraudulent 'donations' (about which we notified them), the unfriendly corporation known as "authorize.net" decided to charge us ten cents for each fraudulent transaction - even after we purchased their so-called "Fraud Protection Suite" for a montly fee. That means that the more than 100,000 fraudulent transactions the bot generated have cost us an enormous amount of money. Authorize.net simply took those disputed charges from the Foundation bank account into which credit card purchases and donations were automatically deposited. To date they have now taken thousands of dollars from our Foundation bank account, including all of your DIA donations from last month, leaving us with a negative account balance. We can't pay DIA. We can't pay our bills. We can't attend the Codex meeting in Rome this coming July. Soon we won't be able to communicate with you at all.

Why? Because today we received this note from DIA: "...past due balance ($6,450). This is unacceptable and if the remainder of the two invoices is not paid by the end of this week we will suspend service and potentially terminate our relationship..."

That's it folks. Unless we raise about $7,000 immediately to pay DIA, we will be terminated by our communication platform. No more concerted efforts that have had such powerful effects...

And unless we raise another $10K to pay our outstanding monthly expenses, and enough money to go to Codex in July, we will be on the outside, looking in... without being there for you.

Well he's a failed legacy regulator.

BILL MOYERS: But he denies that he was a regulator. Let me show you some of his testimony before Congress. Take a look at this.TIMOTHY GEITHNER:I've never been a regulator, for better or worse. And I think you're right to say that we have to be very skeptical that regulation can solve all of these problems. [...]

BILL MOYERS: Welcome to the Journal.

For months now, revelations of the wholesale greed and blatant transgressions of Wall Street have reminded us that "The Best Way to Rob a Bank Is to Own One." In fact, the man you're about to meet wrote a book with just that title. It was based upon his experience as a tough regulator during one of the darkest chapters in our financial history: the savings and loan scandal in the late 1980s.

WILLIAM K. BLACK: These numbers as large as they are, vastly understate the problem of fraud.

BILL MOYERS: Bill Black was in New York this week for a conference at the John Jay College of Criminal Justice where scholars and journalists gathered to ask the question, "How do they get away with it?" Well, no one has asked that question more often than Bill Black.

The former Director of the Institute for Fraud Prevention now teaches Economics and Law at the University of Missouri, Kansas City. During the savings and loan crisis, it was Black who accused then-house speaker Jim Wright and five US Senators, including John Glenn and John McCain, of doing favors for the S&L's in exchange for contributions and other perks. The senators got off with a slap on the wrist, but so enraged was one of those bankers, Charles Keating — after whom the senate's so-called "Keating Five" were named — he sent a memo that read, in part, "get Black — kill him dead." Metaphorically, of course. Of course.

Now Black is focused on an even greater scandal, and he spares no one — not even the President he worked hard to elect, Barack Obama. But his main targets are the Wall Street barons, heirs of an earlier generation whose scandalous rip-offs of wealth back in the 1930s earned them comparison to Al Capone and the mob, and the nickname "banksters."

Bill Black, welcome to the Journal.

WILLIAM K. BLACK: Thank you.

BILL MOYERS: I was taken with your candor at the conference here in New York to hear you say that this crisis we're going through, this economic and financial meltdown is driven by fraud. What's your definition of fraud?

WILLIAM K. BLACK: Fraud is deceit. And the essence of fraud is, "I create trust in you, and then I betray that trust, and get you to give me something of value." And as a result, there's no more effective acid against trust than fraud, especially fraud by top elites, and that's what we have.

BILL MOYERS: In your book, you make it clear that calculated dishonesty by people in charge is at the heart of most large corporate failures and scandals, including, of course, the S&L, but is that true? Is that what you're saying here, that it was in the boardrooms and the CEO offices where this fraud began?

WILLIAM K. BLACK: Absolutely.

BILL MOYERS: How did they do it? What do you mean?

WILLIAM K. BLACK: Well, the way that you do it is to make really bad loans, because they pay better. Then you grow extremely rapidly, in other words, you're a Ponzi-like scheme. And the third thing you do is we call it leverage. That just means borrowing a lot of money, and the combination creates a situation where you have guaranteed record profits in the early years. That makes you rich, through the bonuses that modern executive compensation has produced. It also makes it inevitable that there's going to be a disaster down the road.

BILL MOYERS: So you're suggesting, saying that CEOs of some of these banks and mortgage firms in order to increase their own personal income, deliberately set out to make bad loans?

WILLIAM K. BLACK: Yes.

BILL MOYERS: How do they get away with it? I mean, what about their own checks and balances in the company? What about their accounting divisions?

WILLIAM K. BLACK: All of those checks and balances report to the CEO, so if the CEO goes bad, all of the checks and balances are easily overcome. And the art form is not simply to defeat those internal controls, but to suborn them, to turn them into your greatest allies. And the bonus programs are exactly how you do that.

BILL MOYERS: If I wanted to go looking for the parties to this, with a good b.i.r.d d.o.g, where would you send me?

WILLIAM K. BLACK: Well, that's exactly what hasn't happened. We haven't looked, all right? The Bush Administration essentially got rid of regulation, so if nobody was looking, you were able to do this with impunity and that's exactly what happened. Where would you look? You'd look at the specialty lenders. The lenders that did almost all of their work in the sub-prime and what's called Alt-A, liars' loans.

BILL MOYERS: Yeah. Liars' loans--

WILLIAM K. BLACK: Liars' loans.

BILL MOYERS: Why did they call them liars' loans?

WILLIAM K. BLACK: Because they were liars' loans.

BILL MOYERS: And they knew it?

WILLIAM K. BLACK: They knew it. They knew that they were frauds.

WILLIAM K. BLACK: Liars' loans mean that we don't check. You tell us what your income is. You tell us what your job is. You tell us what your assets are, and we agree to believe you. We won't check on any of those things. And by the way, you get a better deal if you inflate your income and your job history and your assets.

BILL MOYERS: You think they really said that to borrowers?

WILLIAM K. BLACK: We know that they said that to borrowers. In fact, they were also called, in the trade, ninja loans.

BILL MOYERS: Ninja?

WILLIAM K. BLACK: Yeah, because no income verification, no job verification, no asset verification.

BILL MOYERS: You're talking about significant American companies.

WILLIAM K. BLACK: Huge! One company produced as many losses as the entire Savings and Loan debacle.

BILL MOYERS: Which company?

WILLIAM K. BLACK: IndyMac specialized in making liars' loans. In 2006 alone, it sold $80 billion dollars of liars' loans to other companies. $80 billion.

BILL MOYERS: And was this happening exclusively in this sub-prime mortgage business?

WILLIAM K. BLACK: No, and that's a big part of the story as well. Even prime loans began to have non-verification. Even Ronald Reagan, you know, said, "Trust, but verify." They just gutted the verification process. We know that will produce enormous fraud, under economic theory, criminology theory, and two thousand years of life experience.

BILL MOYERS: Is it possible that these complex instruments were deliberately created so swindlers could exploit them?

WILLIAM K. BLACK: Oh, absolutely. This stuff, the exotic stuff that you're talking about was created out of things like liars' loans, that were known to be extraordinarily bad. And now it was getting triple-A ratings. Now a triple-A rating is supposed to mean there is zero credit risk. So you take something that not only has significant, it has crushing risk. That's why it's toxic. And you create this fiction that it has zero risk. That itself, of course, is a fraudulent exercise. And again, there was nobody looking, during the Bush years. So finally, only a year ago, we started to have a Congressional investigation of some of these rating agencies, and it's scandalous what came out. What we know now is that the rating agencies never looked at a single loan file. When they finally did look, after the markets had completely collapsed, they found, and I'm quoting Fitch, the smallest of the rating agencies, "the results were disconcerting, in that there was the appearance of fraud in nearly every file we examined."

BILL MOYERS: So if your assumption is correct, your evidence is sound, the bank, the lending company, created a fraud. And the ratings agency that is supposed to test the value of these assets knowingly entered into the fraud. Both parties are committing fraud by intention.

WILLIAM K. BLACK: Right, and the investment banker that — we call it pooling — puts together these bad mortgages, these liars' loans, and creates the toxic waste of these derivatives. All of them do that. And then they sell it to the world and the world just thinks because it has a triple-A rating it must actually be safe. Well, instead, there are 60 and 80 percent losses on these things, because of course they, in reality, are toxic waste.

BILL MOYERS: You're describing what Bernie Madoff did to a limited number of people. But you're saying it's systemic, a systemic Ponzi scheme.

WILLIAM K. BLACK: Oh, Bernie was a piker. He doesn't even get into the front ranks of a Ponzi scheme...

BILL MOYERS: But you're saying our system became a Ponzi scheme.

WILLIAM K. BLACK: Our system...

BILL MOYERS: Our financial system...

WILLIAM K. BLACK: Became a Ponzi scheme. Everybody was buying a pig in the poke. But they were buying a pig in the poke with a pretty pink ribbon, and the pink ribbon said, "Triple-A."

BILL MOYERS: Is there a law against liars' loans?

WILLIAM K. BLACK: Not directly, but there, of course, many laws against fraud, and liars' loans are fraudulent.

BILL MOYERS: Because...

WILLIAM K. BLACK: Because they're not going to be repaid and because they had false representations. They involve deceit, which is the essence of fraud.

BILL MOYERS: Why is it so hard to prosecute? Why hasn't anyone been brought to justice over this?

WILLIAM K. BLACK: Because they didn't even begin to investigate the major lenders until the market had actually collapsed, which is completely contrary to what we did successfully in the Savings and Loan crisis, right? Even while the institutions were reporting they were the most profitable savings and loan in America, we knew they were frauds. And we were moving to close them down. Here, the Justice Department, even though it very appropriately warned, in 2004, that there was an epidemic...

BILL MOYERS: Who did?

WILLIAM K. BLACK: The FBI publicly warned, in September 2004 that there was an epidemic of mortgage fraud, that if it was allowed to continue it would produce a crisis at least as large as the Savings and Loan debacle. And that they were going to make sure that they didn't let that happen. So what goes wrong? After 9/11, the attacks, the Justice Department transfers 500 white-collar specialists in the FBI to national terrorism. Well, we can all understand that. But then, the Bush administration refused to replace the missing 500 agents. So even today, again, as you say, this crisis is 1000 times worse, perhaps, certainly 100 times worse, than the Savings and Loan crisis. There are one-fifth as many FBI agents as worked the Savings and Loan crisis.

BILL MOYERS: You talk about the Bush administration. Of course, there's that famous photograph of some of the regulators in 2003, who come to a press conference with a chainsaw suggesting that they're going to slash, cut business loose from regulation, right?

WILLIAM K. BLACK: Well, they succeeded. And in that picture, by the way, the other — three of the other guys with pruning shears are the...

BILL MOYERS: That's right.

WILLIAM K. BLACK: They're the trade representatives. They're the lobbyists for the bankers. And everybody's grinning. The government's working together with the industry to destroy regulation. Well, we now know what happens when you destroy regulation. You get the biggest financial calamity of anybody under the age of 80.

BILL MOYERS: But I can point you to statements by Larry Summers, who was then Bill Clinton's Secretary of the Treasury, or the other Clinton Secretary of the Treasury, Rubin. I can point you to suspects in both parties, right?

WILLIAM K. BLACK: There were two really big things, under the Clinton administration. One, they got rid of the law that came out of the real-world disasters of the Great Depression. We learned a lot of things in the Great Depression. And one is we had to separate what's called commercial banking from investment banking. That's the Glass-Steagall law. But we thought we were much smarter, supposedly. So we got rid of that law, and that was bipartisan. And the other thing is we passed a law, because there was a very good regulator, Brooksley Born, that everybody should know about and probably doesn't. She tried to do the right thing to regulate one of these exotic derivatives that you're talking about. We call them C.D.F.S. And Summers, Rubin, and Phil Gramm came together to say not only will we block this particular regulation. We will pass a law that says you can't regulate. And it's this type of derivative that is most involved in the AIG scandal. AIG all by itself, cost the same as the entire Savings and Loan debacle.

BILL MOYERS: What did AIG contribute? What did they do wrong?

WILLIAM K. BLACK: They made bad loans. Their type of loan was to sell a guarantee, right? And they charged a lot of fees up front. So, they booked a lot of income. Paid enormous bonuses. The bonuses we're thinking about now, they're much smaller than these bonuses that were also the product of accounting fraud. And they got very, very rich. But, of course, then they had guaranteed this toxic waste. These liars' loans. Well, we've just gone through why those toxic waste, those liars' loans, are going to have enormous losses. And so, you have to pay the guarantee on those enormous losses. And you go bankrupt. Except that you don't in the modern world, because you've come to the United States, and the taxpayers play the fool. Under Secretary Geithner and under Secretary Paulson before him... we took $5 billion dollars, for example, in U.S. taxpayer money. And sent it to a huge Swiss Bank called UBS. At the same time that that bank was defrauding the taxpayers of America. And we were bringing a criminal case against them. We eventually get them to pay a $780 million fine, but wait, we gave them $5 billion. So, the taxpayers of America paid the fine of a Swiss Bank. And why are we bailing out somebody who that is defrauding us?

BILL MOYERS: And why...

WILLIAM K. BLACK: How mad is this?

BILL MOYERS: What is your explanation for why the bankers who created this mess are still calling the shots?

WILLIAM K. BLACK: Well, that, especially after what's just happened at G.M., that's... it's scandalous.

BILL MOYERS: Why are they firing the president of G.M. and not firing the head of all these banks that are involved?

WILLIAM K. BLACK: There are two reasons. One, they're much closer to the bankers. These are people from the banking industry. And they have a lot more sympathy. In fact, they're outright hostile to autoworkers, as you can see. They want to bash all of their contracts. But when they get to banking, they say, â€˜contracts, sacred.' But the other element of your question is we don't want to change the bankers, because if we do, if we put honest people in, who didn't cause the problem, their first job would be to find the scope of the problem. And that would destroy the cover up.

BILL MOYERS: The cover up?

WILLIAM K. BLACK: Sure. The cover up.

BILL MOYERS: That's a serious charge.

WILLIAM K. BLACK: Of course.

BILL MOYERS: Who's covering up?

WILLIAM K. BLACK: Geithner is charging, is covering up. Just like Paulson did before him. Geithner is publicly saying that it's going to take $2 trillion — a trillion is a thousand billion — $2 trillion taxpayer dollars to deal with this problem. But they're allowing all the banks to report that they're not only solvent, but fully capitalized. Both statements can't be true. It can't be that they need $2 trillion, because they have masses losses, and that they're fine.

These are all people who have failed. Paulson failed, Geithner failed. They were all promoted because they failed, not because...

BILL MOYERS: What do you mean?

BILL MOYERS: But he denies that he was a regulator. Let me show you some of his testimony before Congress. Take a look at this.

TIMOTHY GEITHNER:I've never been a regulator, for better or worse. And I think you're right to say that we have to be very skeptical that regulation can solve all of these problems. We have parts of our system that are overwhelmed by regulation.

Overwhelmed by regulation! It wasn't the absence of regulation that was the problem, it was despite the presence of regulation you've got huge risks that build up.

WILLIAM K. BLACK: Well, he may be right that he never regulated, but his job was to regulate. That was his mission statement.

BILL MOYERS: As?

WILLIAM K. BLACK: As president of the Federal Reserve Bank of New York, which is responsible for regulating most of the largest bank holding companies in America. And he's completely wrong that we had too much regulation in some of these areas. I mean, he gives no details, obviously. But that's just plain wrong.

BILL MOYERS: How is this happening? I mean why is it happening?

WILLIAM K. BLACK: Until you get the facts, it's harder to blow all this up. And, of course, the entire strategy is to keep people from getting the facts.

BILL MOYERS: What facts?

WILLIAM K. BLACK: The facts about how bad the condition of the banks is. So, as long as I keep the old CEO who caused the problems, is he going to go vigorously around finding the problems? Finding the frauds?

BILL MOYERS: You--

WILLIAM K. BLACK: Taking away people's bonuses?

BILL MOYERS: To hear you say this is unusual because you supported Barack Obama, during the campaign. But you're seeming disillusioned now.

WILLIAM K. BLACK: Well, certainly in the financial sphere, I am. I think, first, the policies are substantively bad. Second, I think they completely lack integrity. Third, they violate the rule of law. This is being done just like Secretary Paulson did it. In violation of the law. We adopted a law after the Savings and Loan crisis, called the Prompt Corrective Action Law. And it requires them to close these institutions. And they're refusing to obey the law.

BILL MOYERS: In other words, they could have closed these banks without nationalizing them?

WILLIAM K. BLACK: Well, you do a receivership. No one -- Ronald Reagan did receiverships. Nobody called it nationalization.

BILL MOYERS: And that's a law?

WILLIAM K. BLACK: That's the law.

BILL MOYERS: So, Paulson could have done this? Geithner could do this?

WILLIAM K. BLACK: Not could. Was mandated--

BILL MOYERS: By the law.

WILLIAM K. BLACK: By the law.

BILL MOYERS: This law, you're talking about.

WILLIAM K. BLACK: Yes.

BILL MOYERS: What the reason they give for not doing it?

WILLIAM K. BLACK: They ignore it. And nobody calls them on it.

BILL MOYERS: Well, where's Congress? Where's the press? Where--

WILLIAM K. BLACK: Well, where's the Pecora investigation?

BILL MOYERS: The what?

WILLIAM K. BLACK: The Pecora investigation. The Great Depression, we said, "Hey, we have to learn the facts. What caused this disaster, so that we can take steps, like pass the Glass-Steagall law, that will prevent future disasters?" Where's our investigation?

What would happen if after a plane crashes, we said, "Oh, we don't want to look in the past. We want to be forward looking. Many people might have been, you know, we don't want to pass blame. No. We have a nonpartisan, skilled inquiry. We spend lots of money on, get really bright people. And we find out, to the best of our ability, what caused every single major plane crash in America. And because of that, aviation has an extraordinarily good safety record. We ought to follow the same policies in the financial sphere. We have to find out what caused the disasters, or we will keep reliving them. And here, we've got a double tragedy. It isn't just that we are failing to learn from the mistakes of the past. We're failing to learn from the successes of the past.

BILL MOYERS: What do you mean?

WILLIAM K. BLACK: In the Savings and Loan debacle, we developed excellent ways for dealing with the frauds, and for dealing with the failed institutions. And for 15 years after the Savings and Loan crisis, didn't matter which party was in power, the U.S. Treasury Secretary would fly over to Tokyo and tell the Japanese, "You ought to do things the way we did in the Savings and Loan crisis, because it worked really well. Instead you're covering up the bank losses, because you know, you say you need confidence. And so, we have to lie to the people to create confidence. And it doesn't work. You will cause your recession to continue and continue." And the Japanese call it the lost decade. That was the result. So, now we get in trouble, and what do we do? We adopt the Japanese approach of lying about the assets. And you know what? It's working just as well as it did in Japan.

BILL MOYERS: Yeah. Are you saying that Timothy Geithner, the Secretary of the Treasury, and others in the administration, with the banks, are engaged in a cover up to keep us from knowing what went wrong?

WILLIAM K. BLACK: Absolutely.

BILL MOYERS: You are.

WILLIAM K. BLACK: Absolutely, because they are scared to death. All right? They're scared to death of a collapse. They're afraid that if they admit the truth, that many of the large banks are insolvent. They think Americans are a bunch of cowards, and that we'll run screaming to the exits. And we won't rely on deposit insurance. And, by the way, you can rely on deposit insurance. And it's foolishness. All right? Now, it may be worse than that. You can impute more cynical motives. But I think they are sincerely just panicked about, "We just can't let the big banks fail." That's wrong.

BILL MOYERS: But what might happen, at this point, if in fact they keep from us the true health of the banks?

WILLIAM K. BLACK: Well, then the banks will, as they did in Japan, either stay enormously weak, or Treasury will be forced to increasingly absurd giveaways of taxpayer money. We've seen how horrific AIG -- and remember, they kept secrets from everyone.

BILL MOYERS: A.I.G. did?

WILLIAM K. BLACK: What we're doing with -- no, Treasury and both administrations. The Bush administration and now the Obama administration kept secret from us what was being done with AIG. AIG was being used secretly to bail out favored banks like UBS and like Goldman Sachs. Secretary Paulson's firm, that he had come from being CEO. It got the largest amount of money. $12.9 billion. And they didn't want us to know that. And it was only Congressional pressure, and not Congressional pressure, by the way, on Geithner, but Congressional pressure on AIG.

Where Congress said, "We will not give you a single penny more unless we know who received the money." And, you know, when he was Treasury Secretary, Paulson created a recommendation group to tell Treasury what they ought to do with AIG. And he put Goldman Sachs on it.

BILL MOYERS: Even though Goldman Sachs had a big vested stake.

WILLIAM K. BLACK: Massive stake. And even though he had just been CEO of Goldman Sachs before becoming Treasury Secretary. Now, in most stages in American history, that would be a scandal of such proportions that he wouldn't be allowed in civilized society.

BILL MOYERS: Yeah, like a conflict of interest, it seems.

WILLIAM K. BLACK: Massive conflict of interests.

BILL MOYERS: So, how did he get away with it?

WILLIAM K. BLACK: I don't know whether we've lost our capability of outrage. Or whether the cover up has been so successful that people just don't have the facts to react to it.

BILL MOYERS: Who's going to get the facts?

WILLIAM K. BLACK: We need some chairmen or chairwomen--

BILL MOYERS: In Congress.

WILLIAM K. BLACK: --in Congress, to hold the necessary hearings. And we can blast this out. But if you leave the failed CEOs in place, it isn't just that they're terrible business people, though they are. It isn't just that they lack integrity, though they do. Because they were engaged in these frauds. But they're not going to disclose the truth about the assets.

BILL MOYERS: And we have to know that, in order to know what?

WILLIAM K. BLACK: To know everything. To know who committed the frauds. Whose bonuses we should recover. How much the assets are worth. How much they should be sold for. Is the bank insolvent, such that we should resolve it in this way? It's the predicate, right? You need to know the facts to make intelligent decisions. And they're deliberately leaving in place the people that caused the problem, because they don't want the facts. And this is not new. The Reagan Administration's central priority, at all times, during the Savings and Loan crisis, was covering up the losses.

BILL MOYERS: So, you're saying that people in power, political power, and financial power, act in concert when their own behinds are in the ringer, right?

WILLIAM K. BLACK: That's right. And it's particularly a crisis that brings this out, because then the class of the banker says, "You've got to keep the information away from the public or everything will collapse. If they understand how bad it is, they'll run for the exits."

BILL MOYERS: Yeah, and this week in New York, at this conference, you described this as more than a financial crisis. You called it a moral crisis.

WILLIAM K. BLACK: Yes.

BILL MOYERS: Why?

WILLIAM K. BLACK: Because it is a fundamental lack of integrity. But also because, if you look back at crises, an economist who is also a presidential appointee, as a regulator in the Savings and Loan industry, right here in New York, Larry White, wrote a book about the Savings and Loan crisis. And he said, you know, one of the most interesting questions is why so few people engaged in fraud? Because objectively, you could have gotten away with it. But only about ten percent of the CEOs, engaged in fraud. So, 90 percent of them were restrained by ethics and integrity. So, far more than law or by F.B.I. agents, it's our integrity that often prevents the greatest abuses. And what we had in this crisis, instead of the Savings and Loan, is the most elite institutions in America engaging or facilitating fraud.

BILL MOYERS: This wound that you say has been inflicted on American life. The loss of worker's income. And security and pensions and future happened, because of the misconduct of a relatively few, very well-heeled people, in very well-decorated corporate suites, right?

WILLIAM K. BLACK: Right.

BILL MOYERS: It was relatively a handful of people.

WILLIAM K. BLACK: And their ideologies, which swept away regulation. So, in the example, regulation means that cheaters don't prosper. So, instead of being bad for capitalism, it's what saves capitalism. "Honest purveyors prosper" is what we want. And you need regulation and law enforcement to be able to do this. The tragedy of this crisis is it didn't need to happen at all.

BILL MOYERS: When you wake in the middle of the night, thinking about your work, what do you make of that? What do you tell yourself?

WILLIAM K. BLACK: There's a saying that we took great comfort in. It's actually by the Dutch, who were fighting this impossible war for independence against what was then the most powerful nation in the world, Spain. And their motto was, "It is not necessary to hope in order to persevere."

Now, going forward, get rid of the people that have caused the problems. That's a pretty straightforward thing, as well. Why would we keep CEOs and CFOs and other senior officers, that caused the problems? That's facially nuts. That's our current system.

So stop that current system. We're hiding the losses, instead of trying to find out the real losses. Stop that, because you need good information to make good decisions, right? Follow what works instead of what's failed. Start appointing people who have records of success, instead of records of failure. That would be another nice place to start. There are lots of things we can do. Even today, as late as it is. Even though they've had a terrible start to the administration. They could change, and they could change within weeks. And by the way, the folks who are the better regulators, they paid their taxes. So, you can get them through the vetting process a lot quicker.

BILL MOYERS: William Black, thank you very much for being with me on the Journal.

The rise of sea level the biggest baloney / lie

As of late I've been following articles on pyrabang.com like this one http://www.pyrabang.com?id=5d0e25 debunking
the Al-Goreian fear mongering about the rising sea levels of 20 feet or so.
The data worldwide show no increase in the past 50 years. The issue is related to
global warming and melting of arctic ice. The best
comment I found about global warming is by Charles Lee (from the pyrabang.com article). Does
anyone else besides me have a feeling this past winter/spring has been the
coldest in a long time?? Regardless, I would like your subjective impression about
winter/spring coldness 2008/2009. Please add your location in the comment!

Liberty Children Crash the Tax Revolt Party

I got this from Frank at C4L: Liberty Sons and Daugthers Crashing the Tax Revolt Party!!! It sure appears to me that The Fed will go down peacefully!!!!

What happened Saturday?

130 Sons and Daughters of Liberty showed in full force at the Tax Revolt Saturday in Fullerton California--see link below. Forward the video to the 6:32 minute mark for the front end of procession and at 9:15 there is the tail end and on. We marched a quarter mile to the event.

We handed 500 Campaign for Liberty brochures and 1500 custom made fliers promoting C4L. We collected almost 500 signatures to End the Fed, and passed out pocket Constitutions, Freedom to Fascism dvds. We had a table and tent along side the Young Americans for Liberty table. Also, we distributed the C4L flyer to audit the fed.

We crashed the Tax Revolt party and received a rousing reception. And most of all, we did much good by spreading Ron Paul's message of freedom and liberty to the angry masses. They are listening people!!

Dear Friend of Liberty,

Maybe you've heard, or maybe not, but the Missouri State Police think you might be a security threat.

Why? Because you support Ron Paul and the Campaign for Liberty. Also, because maybe you own guns, oppose abortion or homeschool.

Even, and I'm serious, because you support the U.S. Constitution.

I know, it's ridiculous...and probably steams you a bit.

But here at Campaign for Liberty we are going to give this foolishness the treatment it deserves. More on that in a moment. Let me give you a bit more background.

As you may be aware by now, the Missouri Information Analysis Center (MIAC) recently released a report titled, "The Modern Militia Movement" to over one thousand Missouri law enforcement officers.

What is the Missouri Information Analysis Center? According to its website,

"MIAC is the mechanism to collect incident reports of suspicious activities to be evaluated and analyzed in an effort to identify potential trends or patterns of terrorist or criminal operations within the state of Missouri. MIAC will also function as a vehicle for two-way communication between federal, state and local law enforcement community within our region."

The MIAC warned officers that violent militia members are "usually" supporters of presidential candidates like Ron Paul and are also known for opposition to things like the Federal Reserve and the income tax.

The "study" was undoubtably written by some university liberal who knows nothing of the hundreds of thousands of Missourians who share our values. I can only imagine how many hundreds of thousands of Missouri tax dollars funded this.

Both Ron Paul and Campaign for Liberty champion principles of freedom, peace, and prosperity. We believe that the Founder's vision for America can be reclaimed through education and peaceful activism. It is a common practice of elitist intellectuals and backroom bureaucrats to attempt to crowd everyone into groups and stick labels on them, especially when it involves those who support a Constitutionally-limited government.

Anthony Gregory, editor-in-chief at Campaign for Liberty, has posted an excellent new article on our site concerning government broad-brush fear campaigns.

It is important that we respond in the right way when faced with such a government labeling, and the proper way is to go straight to the top in Missouri.

The way to fight thugs and ignorant people in authority is not to cower or rage, but to proudly proclaim who you are and what you believe.

That's why I urge you to sign our Citizen's Petition here today.

Our petition spells out in no uncertain terms who we are and what we believe. And it reminds those in charge of enforcing Missouri's laws that we are citizen activists who will not be intimidated nor embarassed into silence.

Simply owning a gun does not make you a threat. It means you are a free citizen.

Supporting our Constitution does not make you worthy of a watchlist, it makes you a Patriot.
